“Road to Innovation” Raffle for Subaru Outback or BRZ: Rules and Regulations

 Rules for the Bob Moog Foundation’s Road to Innovation Raffle 

[Updated July 1, 2014]

The Bob Moog Foundation is incorporated as a 501 (c) (3) nonprofit corporation under the laws of the State of North Carolina for the primary purpose carrying forth the legacy of Bob Moog by igniting creativity thought the intersection of music, science, history and innovation. The Bob Moog Foundation Road to Innovation Raffle is conducted for the purpose of generating operating funds.

Purchase one or more raffle tickets during the Bob Moog Foundation Road to Innovation Raffle  and you’ll be entered in a drawing to win one of two cars of your choosing – either a 2014 Subaru Outback station wagon or a 2014 BRZ Coupe — or one of the additional prizes. Prizes will be awarded in order of name drawn.

First Additional Prize: Korg MS-20 Mini synthesizer

Second Additional Prize: Dubreq Stylophone synthesizer

Third Additional Prize: SampleMoog® Synth Anthology by IK Multimedia

Fourth Additional Prize: The Synthesizer, signed by Mark Vail

Raffle tickets are $50 each. Odds of winning are based on the number of ticket entries purchased. No more than 2000 tickets will be sold. Must be 18 years of age or older. The raffle is open internationally. Contest void where prohibited. Sweepstakes begin at 12:01 am on April 9, 2014 and ends at midnight on September 5, 2014. The drawing will take place on September 8, 2014. All times referenced for the Bob Moog Foundation Road to Innovation Raffle are Eastern Time.

HOW TO ENTER: There are three ways to enter.

  1. Go to  BMF online store and complete the online entry form and pay entry fee with your credit card.
  2. Call the Bob Moog Foundation at 828-258-1262 during regular business hours, M-F. Provide your entry information (name, address, telephone, email) over the phone along with credit card information.
  3. Mail completed entry form to the Bob Moog Foundation, 2 Wall Street, Suite 108, Asheville, NC 28801 with your payment for $50 per ticket. Entry forms may be obtained at the Bob Moog Foundation at 828-258-1262 or by downloading and printing The Bob Moog Foundation Road to Innovation Raffle Entry Form at http://moogfoundation.org/raffle-entry-form/. Mailed entries must be received by the Bob Moog Foundation no later than 5pm on the afternoon of September 5, 2014.

ELIGIBILITY: Present employees of the Bob Moog Foundation and any immediate family members residing with the employees are not eligible to participate. Present board members of the Bob Moog Foundation and any immediate family members residing with board members are not eligible to participate. Employees of Prestige Subaru and any immediate family members residing with Prestige Subaru employees are not eligible to participate. Must be 18 years or older to enter. Contest void where prohibited. You need not be present to win.

SELECTION AND NOTIFICATION OF WINNERS:  Winners will be selected at random and announced through the Bob Moog foundation social media. Once submitted, entries become the sole property of the Bob Moog Foundation and will not be returned. Winners will be notified by telephone, mail and/or email. If potential winner(s) cannot be reached after 10 days from first notification attempt, or if an entrant is found to be ineligible, or a prize notification is returned as undeliverable, such prize will be forfeited and alternate winner(s) will be selected by random drawing.

PRIZE: Grand prize is a choice of either a 2014 Subaru Outback station wagon  ($23,595 MSRP) or a 2014 BRZ Coupe (MRSP $25,595). Additional prizes are: Korg MS-20 Mini synthesizer ($599 MRSP), Dubreq Stylophone synthesizer (MRSP $512.75) (SampleMoog® Synth Anthology by IK Multimedia ($99 MSRP), The Synthesizer, signed by Mark Vail ($50 value). The Grand Prize winner will have a choice of choosing one of the additional prizes in lieu of the car if so desired.

MODIFICATIONS OR CANCELLATION OF DRAWING: The Bob Moog Foundation reserves the right to cancel or modify the Raffle. If 450 tickets are not sold by 5pm on September 5, 2014, The Bob Moog Foundation, at its option, may cancel the drawing.

IMPORTANT CAR INFORMATION: Upon verification of the winner, the Bob Moog Foundation will notify Prestige Subaru to finalize the transfer of the vehicle to the winner. Any and all logistics and fees needed to transport the vehicle (if applicable) will be the sole responsibility of the winner.

The vehicle is either a 2014 Subaru Outback station wagon or a 2014 BRZ Coupe, base models.

  • The 2014 Subaru Outback has  Subaru Symmetrical All-Wheel Drive and a rugged suspension, giving the driver car-like handling with SUV capabilities. The 173-hp 2.5-liter 4-cylinder SUBARU BOXER engine and Lineartronic CVT combine to get up to 30 highway MPG and over 550 miles per tank.
  • The BRZ’s sculpted exterior helps it cut through the air with ease for a low coefficient of drag and up to a remarkable 34 highway MPG. It comes with a 200-hp direct-injected 2.0-liter 4-cylinder SUBARU BOXER engine, close-ratio 6-speed manual transmission, sport-tuned suspension, and an 8-speaker audio system with integrated touch-screen navigation.

The terms of the car dealership’s and manufacturer’s automobile transfer documentation will govern issues of liability relating to the prize after acceptance of the automobile by the Winner.

INDEMNIFICATION AND LIMIT ON LIABILITY: As a condition of accepting a prize, winner acknowledges that the Bob Moog Foundation is not responsible for any harm, injury, or damage caused to any person or property, proximate or otherwise, through the use of any prize by any person, and agrees to save and hold harmless the Bob Moog Foundation, its principals and employees from any claim of such responsibility. “Harm, injury or damage” includes but is not limited to occurrences beyond the control of the Bob Moog Foundation such as death, bodily injury, property damage, or theft, or for failure of any automobile manufacturer’s or dealership’s warranties.

GENERAL: Ticket purchases are not tax deductible. By entering the raffle, participants agree that the Bob Moog Foundation, its agents and employees have no liability whatsoever for any injuries, losses, or damages of any kind which result from the date of award. The prize is non-transferable, and cannot be exchanged for cash. The Bob Moog Foundation may use winner’s name and likeness for publicity purposes without further compensation. The Bob Moog Foundation is not responsible for any failure of communication or failure of the Internet or its website. The Bob Moog Foundation reserves the right to modify these rules and will give prompt announcement of any rule changes. All decisions of the Bob Moog Foundation are final and binding in all matters related to this raffle.

TAX OBLIGATIONS:  If the winner of the car is from NC, they will pay 3% state tax plus $65 for a vehicle registration to Prestige Subaru. Winner will also pay 25% of MSRP minus cost of raffle ticket by certified check to the Bob Moog Foundation for the IRS (Uncle Sam makes us do this! The Bob Moog Foundation does NOT keep the money from the check. It is for our filing with the IRS). All local, state and federal, and international (if applicable) taxes are the sole responsibility of the winner. For any prizes values at $600 or more, the Bob Moog Foundation will file IRS Form 1099 MISC with Internal Revenue Service reporting the value of the prize as income to the winner. Winner must show proof of social security number of the Bob Moog Foundation. This is for tax recording purposes only, and will be not be used or released for any other purposes.

RESTRICTIONS: By participating in the Bob Moog Foundation Road to Innovation Raffle, a participant agrees to be bound by these Official Rules, and by all decisions of the Bob Moog Foundation. For further information, please call the Bob Moog Foundation at (828) 258-1262.

AFFIDAVIT OF ELIGIBILITY AND LIABILITY / PUBLICITY RELEASE OF GRAND PRIZE WINNER: The Winner of the grand prize must show proof of valid driver’s license and will be required to sign an Affidavit of Eligibility and Publicity/Liability Release in order to claim their prize.

AUTHORITY AND CONTROL: The decision of the Bob Mooshall be final in all matters concerning the Raffle. The Raffle is subject to the laws of the state of North Carolina. The Raffle is void where prohibited by law. The Bob Moog Foundation is not responsible for any errors or omissions in the Raffle’s advertising and/or any printed, broadcast, or internet-provided materials or information.

OVERSIGHT: The accounting firm of Corliss & Solomon, PLLC will officiate the drawing of the Grand Prize.

    Could you explain the reason for this? I’ve never heard of this before.

    Rodman, the reason is that’s just how NC nonprofit tax law works. The 25% does not go to the Foundation, but to the IRS. Tax laws vary from state to state, and that’s how North Carolina tax law works.
